Terms of Service

These terms govern authorised access to the Alcanca website, business platform and mobile application.

01

Who provides the service

The service is provided by Alcanca Group OÜ, an Estonian private limited company with registry code 17299925 ("Alcanca", "we", "us" or "our").

These terms apply to the Alcanca website, CRM and mobile application. If an organisation has a separate written agreement with Alcanca, that agreement takes priority where it conflicts with these terms.

02

Accounts and authority

The Alcanca App does not create public consumer accounts. Access is provided by Alcanca or by an organisation using the Alcanca platform. You must be authorised by that organisation, provide accurate information, protect your credentials and use only the businesses and data you are permitted to access. You are responsible for activity performed through your account unless you notify us promptly of suspected unauthorised access.

03

Licence and ownership

Subject to these terms and the organisation's agreement, Alcanca grants authorised users a limited and revocable right to use the service for the organisation's internal business purposes. This right is neither exclusive nor transferable. Alcanca and its licensors retain all rights in the software, design, trademarks and service. The organisation retains its rights in the customer content it submits to the platform.

04

Acceptable use

Users must not:

  • access another person's account or another organisation's data;
  • send unlawful, deceptive, abusive or unsolicited communications;
  • circumvent consent, requests not to be contacted, carrier or provider requirements;
  • interfere with the service, probe security controls or introduce harmful code;
  • use recordings, messages or personal data without the permissions required by law.
05

Customer content and communications

The organisation and its users are responsible for the lawfulness, accuracy and permissions associated with content placed in Alcanca. Phone, SMS, WhatsApp, email and push delivery depend on external networks and providers. Users remain responsible for recipients, consent, content, suppression requests and applicable communication laws. Delivery and availability cannot be guaranteed where a carrier, operating system, device, recipient or external provider is unavailable.

06

Business service

The mobile app is a companion to an organisation's existing Alcanca service. Any commercial agreement between Alcanca and that organisation continues to govern subscription, support, data ownership and commitments specific to the service. The App Store download itself is free and does not create a separate paid subscription.

07

Availability, changes and suspension

Alcanca may maintain, secure, modify or discontinue features when reasonably necessary. Features presented as unavailable are not part of the current service. We aim to preserve customer data and provide notice of material changes where appropriate. Access may be limited or suspended to protect the service, comply with law, respond to a failure to pay under an organisation's agreement or address a material breach of these terms.

08

Disclaimers and responsibility

The service is provided with reasonable skill and care, but internet, carrier and external services can fail or be unavailable. To the fullest extent permitted by law, Alcanca is not responsible for indirect or consequential loss, loss caused by unauthorised or unlawful use, or failures outside its reasonable control. Nothing in these terms excludes liability that cannot lawfully be excluded or limits mandatory rights that apply to you.

09

Termination

Your access ends when the authorising organisation removes it, its service agreement ends, or Alcanca terminates access for a material breach. Provisions concerning ownership, responsibility and applicable law continue where their nature requires it.

10

Applicable law

These terms are governed by Estonian law. Disputes that cannot be resolved informally are subject to the competent courts of Estonia, except where mandatory law gives an individual the right to bring a claim elsewhere.

11

Changes to these terms

We may update these terms when the service or legal requirements change. Material changes will be communicated where reasonably practicable. The current version and update date will remain available at this URL.
